Terms of Use
1- Introduction
These Terms of Use ("Terms") govern your access to and use of the MasrPay mobile application, web interfaces, and related payment services provided by MasrPay For Payment Solutions S.A.E ("MasrPay", "we", "us"). By installing, accessing, or using the App or Platform, you agree to be bound by these Terms and our Privacy Policy. Applicable Egyptian laws include, without limitation: Central Bank and Banking System Law No. 194 of 2020, Personal Data Protection Law No. 151 of 2020, Consumer Protection Law No. 181 of 2018, the Egyptian Civil Code, the Anti-Money Laundering framework, and the Electronic Signature Law No. 15 of 2004. We will investigate and respond within 10 business days from the date of complaint submission. Support SLA: We acknowledge complaints within 24 hours and aim to resolve issues within 5 business days.
2- Definitions
“App” means the MasrPay mobile application)s( )iOS/Android(. “Platform” means the App, web portals, APIs, dashboards, and backend services. “User” means any person or entity that uses the Platform. “Merchant” means a business using MasrPay to accept payments. We will investigate and respond within 10 business days from the date of complaint submission.
3- Scope & Purpose
MasrPay provides electronic payment services including initiating and processing transactions, accepting online/in‑store payments, electronic invoicing, settlements, and reporting. Use is limited to lawful transactions and purposes permitted by these Terms and applicable law. We will investigate and respond within 10 business days from the date of complaint submission.
4- Eligibility
You must be at least 18 years old with full legal capacity. Corporate Users must be duly established and authorized. You must not appear on sanctions lists. We may request KYC/AML documents and updates.
5- Account Registration & Security
You are responsible for all activity under your account, for safeguarding credentials, and for promptly notifying MasrPay of any suspected unauthorized access, device loss, or SIM swap. Do not use the App on jailbroken or rooted devices; this may lead to suspension.
6- End‑User License (EULA)
Subject to these Terms, MasrPay grants a limited, non‑exclusive, revocable, non‑transferable license to install and use the App on a device you own/control. You must not copy, modify, reverse engineer, or create derivative works except where prohibited restrictions by law apply.
7- Updates
You consent to receive and install updates, patches, and new versions which may add, modify, or remove features. Continued use after updates constitutes acceptance.
8- App Store Terms
Apple: These Terms are between you and MasrPay, not Apple. Apple has no maintenance/warranty obligations; Apple and its subsidiaries are third‑party beneficiaries. Google: Google is not responsible for support or liabilities; you must comply with Google Play policies.
9- Prohibited Activities
No illegal or unauthorized goods/services, money laundering or terrorist financing, sanctions evasion, scraping, or interference with security/integrity. We may suspend/terminate and cooperate with authorities.
10- Fees & Taxes
Fees and charges are disclosed in‑App or in Merchant agreements. You are responsible for VAT and bank/network fees. We may change fees with notice as required by law.
11- Payments, Refunds, Chargebacks & Errors
Report unauthorized transactions or errors promptly via the App or support@masrpay.com. We investigate under applicable CBE rules and network rules. Refunds are subject to Merchant policies; chargebacks may result in debits and fees. Settlements may be withheld pending investigations or regulatory orders. We will investigate and respond within 10 business days from the date of complaint submission.
12- AML/CFT & Sanctions
You consent to screening, monitoring, and information requests under AML/CFT obligations. We may decline, freeze, or reverse transactions and report to competent authorities.
13- Data Privacy & Permissions
Processing is subject to our Privacy Policy and PDPL No. 151/2020. By using the App, you consent to processing for service provision, fraud prevention, and risk management; optional marketing requires explicit consent. App permissions (camera, location, contacts, biometrics) are used only for stated purposes and controllable in device settings. You may exercise rights of access, correction, deletion, and objection subject to legal exceptions. Lawful mechanisms apply to cross‑border transfers.
14- Electronic Signatures & Records
You agree that electronic records, OTP approvals, and e‑signatures executed via MasrPay have the same legal effect as handwritten signatures to the extent permitted by Egyptian law, including Law No. 15/2004. Do not print and wet‑sign documents designated for e‑signature unless expressly authorized.
15- Intellectual Property
The Platform, App, software, trademarks, and content are owned or licensed by MasrPay. Except for the limited license above, no rights are granted. Feedback may be used by MasrPay without obligation as permitted by law.
16- User Content (Merchants)
If you upload logos, product data, or content, you warrant you have the necessary rights and grant MasrPay a non‑exclusive license to host and use such content to provide the services.
17- Consumer Protection & Complaints
We ensure transparent terms, pricing, and consent mechanisms. For complaints, contact support@masrpay.com. If unresolved, you may escalate to the Consumer Protection Agency in accordance with Law 181/2018. Support SLA: We acknowledge complaints within 24 hours and aim to resolve issues within 5 business days.
18- Suspension & Termination
We may suspend or terminate for breaches, suspected fraud, regulatory requests, insolvency, or risk. You may request account closure at info@masrpay.com. Deleting the App does not close your account or stop lawful data retention.
19- Dispute Resolution
Disputes should first be addressed through good‑faith negotiations. For consumer claims below EGP 100,000, either party may file before the competent Egyptian courts., either party may file before the competent Egyptian courts. Otherwise, disputes shall be referred to arbitration under the CRCICA Rules. Seat: Cairo, Egypt. Language: Arabic. Nothing limits our right to seek urgent injunctive relief from competent courts.
20- Warranties & Liability
The Platform is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties. We are not liable for indirect, incidental, or consequential damages, third‑party outages, or unauthorized access beyond our reasonable control. Our aggregate liability is limited to service fees paid by you in the three months preceding the incident.
21- Force Majeure
We are not liable for delays or failures caused by events beyond reasonable control (including natural disasters, governmental actions, war, cyberattacks, or disruptions in telecommunications or banking infrastructure).
22- Regulatory Cooperation
We cooperate with competent Egyptian authorities, including the Central Bank of Egypt, the Egyptian AML Unit, and the Egyptian Data Protection Centre, and maintain records and audit trails as required by law.
23- Amendments
We may amend these Terms at our discretion. Material changes will be notified in‑App or by email. Continued use constitutes acceptance.
24- Communications & Notifications
You consent to receive notifications via the App, email, SMS, or push notifications for service, security, and legal purposes. You may manage certain preferences in settings; service/security notices are mandatory.
25- Language
These Terms are available in Arabic and English. In case of discrepancy, the Arabic version prevails.
